Terms of Service

This is a Terms of Service agreement — it is not the Privacy Policy and not the SMS Program Disclosure (those are separate documents, linked below).

These Terms of Service ("Terms") form a binding agreement between Dustin Mooney, doing business as Mooney & More ("the Operator," "we," "us"), and each invited user ("User," "you") of the Merlin personal AI assistant service ("Merlin," "the Service"). By using the Service you agree to these Terms.

1. The Service

Merlin is a private, invite-only AI assistant operated for the Operator's personal and household use. Accounts exist only by the Operator's personal invitation. There is no public registration, no fee, and no commercial offering. These terms govern use of the Service by invited users ("Users").

2. AI disclosure

Merlin is an artificial-intelligence assistant, not a human. It identifies itself as an AI in its communications. AI-generated responses can be wrong, incomplete, or out of date; Users should independently verify information before relying on it for significant decisions. The Service does not provide medical, legal, or financial advice.

3. Messaging consent

By texting the Service's number from a registered device, a User consents to receive conversational replies by SMS/RCS. The Service messages only registered Users who initiate contact; it sends no marketing. Message frequency varies with use; message and data rates may apply. Text STOP to end messaging at any time, HELP for assistance.

4. Acceptable use

Users agree not to use the Service for unlawful purposes; to send spam or unsolicited messages to third parties; to attempt to access another User's data; or to probe, disable, or circumvent the Service's security measures. Actions the assistant can take on external accounts require the User's explicit per-action confirmation.

5. Connected services

Users may optionally connect third-party accounts (such as email or calendars). Doing so authorizes the Service to access those accounts solely to carry out that User's own requests. A User may disconnect any service at any time, which revokes the Service's access.

5a. Browser extension

The Service offers an optional Chrome browser extension as a client to a User's own account. The extension functions only after the User pairs it with a one-time code generated inside their account; installing it grants no access to the Service by itself. Users choose which websites the extension may read via a per-site allowlist, and are responsible for those choices. Features that operate the browser on the User's behalf act only with the User's explicit per-action approval, and all such actions are recorded in the Service's audit log. The extension's data practices are described in the Privacy Policy.

6. Privacy

Handling of personal information is described in the Privacy Policy, which is part of these terms.

7. Availability and warranty disclaimer

The Service is a personal project provided "as is" and "as available," without warranties of any kind, express or implied. The Operator does not guarantee uninterrupted operation, and may modify, suspend, or discontinue the Service (or any account) at any time.

8. Limitation of liability

To the maximum extent permitted by law, the Operator's total liability arising from or relating to the Service will not exceed one hundred U.S. dollars (US $100). The Operator is not liable for indirect, incidental, special, or consequential damages.

9. Governing law

These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules.

10. Changes

The Operator may update these terms; material changes will be reflected on this page with an updated date above. Continued use after changes constitutes acceptance.
